XING TRAVEL Sales Terms & Conditions (California-Compliant)
These Sales Terms & Conditions apply to all travel products and services booked through **XING TRAVEL**. Clients should read carefully before making any payment.
## 1. Contractual Relationship and Scope
1. XING TRAVEL acts as the organizer or agent for travel products and services provided to clients.
2. These Terms & Conditions constitute a legally binding agreement between the client and XING TRAVEL.
3. By completing payment, the client acknowledges that they have read, understood, and agreed to all terms outlined herein.
## 2. Pricing, Payment, and Confirmation
1. All prices are accurate at the time of confirmation and may change due to exchange rates, fuel surcharges, taxes, or supplier policies.
2. XING TRAVEL reserves the right to adjust prices reasonably prior to confirmation and will notify clients in advance.
3. Orders are considered confirmed only after payment is received and XING TRAVEL has issued confirmation.
## 3. Deposit and Payment Policy
1. Certain travel products require a deposit to secure a reservation.
2. Deposits are used to lock in the booking and pay third-party suppliers.
3. Except as otherwise required by law or stated in these Terms, deposits are generally non-refundable upon cancellation.
4. In certain cases, XING TRAVEL may, at its discretion, convert deposits into a travel credit valid for future bookings within a specified period.
## 4. Cancellation and Refund Policy
### 1. Client-Initiated Cancellation
If a client cancels a trip, refunds and fees will be applied according to the cancellation schedule for each specific product:
* Cancellations made sufficiently in advance: refund of the balance minus incurred costs;
* Cancellations close to the departure date: may be non-refundable.
Specific cancellation policies are provided in writing for each product.
### 2. XING TRAVEL Cancellation
If a trip is canceled by XING TRAVEL due to insufficient participants, supplier issues, or other reasonable business reasons:
* Paid amounts will be refunded in accordance with applicable law; or
* With client consent, converted into equivalent travel products or travel credit.
### 3. Force Majeure
If the itinerary cannot proceed as planned due to force majeure (including but not limited to natural disasters, war, pandemics, government actions, flight cancellations, etc.):
* XING TRAVEL will reasonably assist clients in communicating with suppliers;
* Refund amounts depend on third-party supplier policies;
* XING TRAVEL does not guarantee full refunds but will handle claims reasonably and lawfully.
## 5. Itinerary Changes and Substitutions
1. XING TRAVEL reserves the right to adjust the itinerary sequence, hotels, or transportation methods as necessary to ensure smooth execution of the trip.
2. Clients will be notified in advance in case of significant changes.
## 6. Client Responsibilities
1. Clients must provide true, complete, and valid personal information.
2. Clients must ensure that passports, visas, vaccinations, and entry requirements are satisfied.
3. Any loss incurred due to client-related reasons (including documentation issues, tardiness, or health conditions) is the client’s responsibility.
## 7. Liability Limitation and Disclaimer
1. XING TRAVEL does not directly provide airline, hotel, transportation, or sightseeing services; these services are provided by independent third-party suppliers.
2. To the extent permitted by law, XING TRAVEL is not liable for losses resulting from third-party suppliers, force majeure, or client actions.
3. These Terms do not exclude or limit any liability that cannot be legally excluded, including liability arising from gross negligence or willful misconduct.
## 8. Insurance Recommendation
XING TRAVEL strongly recommends that clients purchase travel insurance covering medical emergencies, cancellations, baggage, and trip interruptions.
## 9. Dispute Resolution and Governing Law
1. These Terms and any disputes arising from them are governed by the laws of the State of California, USA.
2. Both parties agree that any disputes will be submitted to a court of competent jurisdiction in California.
## 10. Amendments
XING TRAVEL reserves the right to update and modify these Terms as allowed by law. Updated terms apply to bookings made after such modifications.
## High-Risk Destinations Addendum (Africa / South America / Polar Regions, etc.)
This addendum applies to destinations including but not limited to Africa, South America, Antarctica, remote regions, and locations with limited medical facilities.
### 1. Risk Acknowledgment
Clients understand and acknowledge that high-risk destinations may involve:
* Limited medical resources;
* Unstable transportation and communication;
* Weather, political, or public health risks.
Clients accept these risks voluntarily.
### 2. Health and Insurance
Clients must confirm that they are physically fit for the trip and are **strongly recommended** to purchase travel insurance covering medical emergencies, emergency evacuation, and trip cancellation.
### 3. Itinerary Adjustments
If itinerary changes or cancellations are required due to safety, weather, or force majeure, client safety will be the top priority, and fees will be handled reasonably and in accordance with applicable law.
## Payment Acknowledgment
By completing payment, you acknowledge that you have read and agree to XING TRAVEL’s California-compliant Terms & Conditions, including any addenda.
These Terms and Addenda are governed by the laws of the State of California, USA.
